Default Sigma 70-210 Apo 2.8 error 99 on anything except AP 2.8

I bought a lens from someone it's a Sigma Apo f2.8 70-210.

It all looks nice and does work on the 10D, but as soon as I choose an aperture higher than 2.8 the photo is taken but err 99 blinks.

According to the seller this never happened (I asked when I bought), does the lens needs to be rechipped ?

Yes, definitely. Sigma does this for free of charge. The new version 70-200mm F/2.8 HSM APO work fine on the 10D, and the AF is very fast (almost as good as Canon USM).

For what I saw on 2.8 the lens is VERY sharp.
Sigma NL said it will not chip older lenses anymore, I mailed to Sigma US.
