good question.. I presented this question as somewhat of a debate able topic... but.. I guess from the photographer's point of view and what they should have written when signing a client... say for a wedding.

I myself am a 'lil paranoid, (years of watching tv court shows)
so i'd try to include a clause so they can't sue if you screw up.. :-)
(but thats mostly for the one time events.. weddings, grad's, ect)

I'd be sure to clearly put down who is expected to be the owner
of the negitives (or digital files) and if it is them, the client..
then i'd charge a bit more.

also,
try to slip a clause for express permission to use likeness in promotions..
(so any great, super duper shots can be included in any advertising you may do)

i myself am not a exactly an expert when it comes to the legality side
of photography and what the standard rights are of a photographer
but i would still include those so theres no surprises to the client.

I would suggest you get the book:
John Shaw's Business of Nature Photography: A Professional's Guide to Marketing and Managing a Successful Nature Photography Business
by John Shaw
http://www.amazon.com/gp/product/081744050X/qid=1138997688/sr=1-5/ref=sr_1_5/002-0718750-4182437?s=books&v=glance&n=283155

It covers loads of good stuff, including this.

There are many issues that need to be addressed that we can't answer unless you say what type of photography. For example, do you have a model to deal with? What rights do they have to the images?
