Nothing wrong with the hat. It isn't shading his face, and it suits him well. I'm not taken with the pose, though - it looks too much like he is squatting, rather than sitting. Other than that, it is a pretty good shot, and I like the B&W treatment.

no, I know the shot is perfect. Listen to Town with no Cheer (Tom Waits) on Scarlett Johansson's First album. The Singer here is from the band Hailey. It is amazing to see the scene here.

Asking him to remove his hat? How about his shirt, his pants, his sandals. Anything else you dont like him wearing? You never ask someone to remove something unless it really screws up the picture, otherwise dont shoot it at all. Personally I think the hat suits the guy and the rest of the casual clothing he is wearing.

I like the shot the way it is, as that shows the subject the way was on that day. Sometimes unposed shots (or shots that look unposed) work the best.
