I am pretty sure that it's a Sharp-shinned Hawk. A juvenile a little over a year old. As they mature their eyes go from yellow to redish brown. It looks like your hawk is about the right size too. 11-12 inches tall? They are related to the Cooper's Hawk family. I suppose it could also be a juvenile Coopers. They are very similar except for size. Coopers are a little bigger.

If anyone else wants to verify or correct my ID please jump in.

Nice photo BTW. Looks like the bird forgot something and is looking back.
